What are Privacy Regulations?

On May 25th 2018, a European Union privacy regulation—known as the General Data Protection Regulation (GDPR)—came into effect. The aim is to protect the personal data of all EU citizens. Whatever the location of your business, if you own a website with EU visitors, or if your marketing campaigns target EU citizens, these changes affect you.
Similar legislation known as the California Consumer Privacy Act (CCPA) was enacted on January 1st, 2020. This act protects the personal data rights of consumers who are defined as residents of California.
In August 2020, Brazil introduced the Lei Geral de Proteção de Dados (LGPD), which serves to protect the fundamental right to privacy and the protection of the personal data of Brazilian citizens.
The CCPA, LGPD and the GDPR grant customers - among other rights - the right to access data that site-owners have collected, as well as the right to have that data permanently deleted.

Preparing for privacy regulation as a Wix site owner

Data privacy compliance can be complex.
In over 80 countries, privacy laws have been enacted in order to improve information privacy and security. GDPR, the CCPA and the LGPD are just three examples of privacy legislation.
The first step should be to understand your legal obligations and your business’s need to comply with specific regulations. Privacy laws that apply to your website can be affected by the privacy laws in both your and your visitors/customers countries of residence.
Among other actions, you’ll need to create a privacy policy, letting visitors know how your site processes their data—including information on cookies and other tracking technologies.

Tools available at Wix to assist you

From your dashboard, site owners are able to handle all data requests from your site visitors—like accessing their data or permanently deleting their data
You can add a cookie banner to request consent from your visitors to use cookies and similar technologies.
You can add a link to allow visitors to Opt-Out of a “Sale” of their personal information.

Wix offers you the ability to build forms and collect data from your visitors using Wix Forms. This includes the option to add a checkbox to receive explicit consent from your visitors to process their data.

Since only a site owner can handle data requests from visitors, you should discuss solutions with your clients directly. You can address all data requests yourself, transfer ownership of completed sites back to your clients, or find an alternative solution.
