Selling CBD on Your Wix Site

If your business is based in the U.S., you can use Wix to sell hemp and/or hemp-derived CBD products online. Complete our declaration form, connect to a payment provider that works with CBD merchants and start accepting payments from all major credit cards. Before getting started, read the following article and make sure you fully understand the terms for selling CBD products on your site.

As a U.S. merchant, you must comply with federal and state law, as well as FDA and other applicable regulations, defining what hemp-derived CBD products you can legally sell. 

The U.S. federal law* defines Hemp as the following:

The Cannabis Sativa L. plant with no more than 0.3% THC concentration on a dry weight basis. This includes any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not.

*Agriculture Improvement Act of 2018 ("Farm Bill")

In addition to the federal law, states in the U.S. have issued their own regulations or declarations regarding the sale, purchase, possession and consumption of hemp and CBD products. Certain states have no explicit law that either allows or prohibits the retail sales of such products. 

These laws, declarations and policy statements are separate and unrelated to any laws governing medical use of cannabis and other THC-containing products. As a Wix user, it is your responsibility to be familiar with the regulations relevant to your business. 

Wix does not support the sale or purchase of hemp and hemp-derived CBD products in the following U.S. states: 

This means that your business cannot be located in the above states, nor can you ship hemp or hemp-derived CBD products to customers residing there. 

In addition to state and federal law, the FDA also governs the sale of hemp and hemp-derived products. We recommend checking the FDA's website on a regular basis for more instructions on selling these products, as well as cosmetics and supplements. 

Every Wix site owner interested in selling hemp and hemp-derived products in the U.S. must comply with the following requirements: 

Before connecting to a payment provider and selling Hemp products on your site, you're required to read and submit this declaration. 

The declaration form describes the legal terms for selling hemp and hemp-derived products on Wix. By submitting it, you confirm that your business is located in a U.S. state we can support and that your shipping area is limited to that same list of states. You're also confirming that the products on your site answer Wix's requirements. 

Wix has partnered with third-party payment providers, Square, Bankful, Priority Payments and Evergreen Payments Northwest so you can securely accept payments for hemp and hemp-derived CBD products on your site.  

If you haven't yet connected your site to a payment provider, you'll be able to connect Square, Bankful or Evergreen Payments Northwest right after submitting the declaration form. You can either create a new account with Square or connect an existing account if you have one. 

If your site is connected to a provider that doesn't support the sale of hemp and hemp-derived, you'll be able to change it after submitting the declaration form.  

Currently, Wix Payments does not process payments for hemp or CBD products. If you would like to sell these products on your site and have already connected to Wix Payments, you'll be automatically disconnected once you submit the declaration form.

Under federal law, constituents derived from hemp means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.

No. As stated in our Declaration for Selling Hemp and CBD Products, you are only allowed to sell hemp-derived CBD products. These products cannot contain more than 0.3 percent of delta-9 tetrahydrocannabinol (THC) concentration (on a dry weight basis). Additionally, they must not contain any Controlled Substances as defined in Schedule IV of Title 32 United States Code Controlled Substances Act. 

Yes. You can use the same Wix site to sell hemp and/or hemp-derived CBD products alongside other products of any kind, as long as your chosen payment provider allows it in their terms and conditions. If you already have a store that's up and running and would like to add products, you can either add the products there or create a new site. Which Wix Apps can I use while selling hemp and/or hemp-derived products CBD products on my site? 

You may use any Wix app (e.g. Wix Stores, Wix Bookings, Pay Button) for selling hemp and/or hemp-derived products CBD products.

Wix's solution is designated for users selling hemp and hemp-derived products in the U.S. states that we support. 

As with any other product you want to sell on Wix, you should check local regulations before actually adding them to your site. If you're located outside of the U.S. and would like to start selling hemp and hemp-derived products, we highly recommend consulting with an attorney to find out what regulations apply to you. 

Additionally, you must verify with your payment provider that they're able to process payments for hemp and hemp-derived products.  

Like any other Wix user, you are responsible for your site's content and the products you sell. When using Wix to sell hemp and/or hemp-derived CBD products, you are responsible for understanding the federal, state and local regulations that apply to them. 

As U.S. laws regarding hemp and CBD products continue to develop, we recommend reviewing them on a regular basis, as well as the FDA's regulation of Cannabis and Cannabis-derived products (Learn More). 

Wix will not notify users of changes made to these laws. We highly recommend consulting with an attorney before selling these products on your site.

You can use any carrier that can legally deliver help and/or hemp-derived CBD products. We recommend contacting the relevant shipping service to check this in advance.  

As a Wix user, you are not limited to the specific providers we've partnered with for this solution. As long as your chosen provider is integrated with Wix, and supports the sale of hemp and/or hemp-derived CBD products, you may use it to process your payments. 

It's important to note that many payment providers don't process these transactions, so we highly recommend checking with them in advance.  

Yes. If your Wix Payments account was closed due to this particular line of business, you can still use Wix as a platform to sell these products. To get started, read and submit the Declaration for Selling Hemp and Hemp Derived Products. 

Wix Payments cannot process any transactions related to hemp and/or hemp-derived CBD products. For this reason, we'll disconnect and close your Wix Payments account once you submit the declaration form.  

Any credit remaining in your Wix Payments account will be paid out according to your current payout cycle, as long as our compliance team can confirm that these funds aren't associated to the sale of restricted or prohibited products. 

If your Wix payments account was closed due to the sale of restricted or prohibited goods / services, any credit remaining in your account has been or may be refunded to the credit card owner (your customer).

The Wix Payments Restricted and Prohibited Businesses list is applicable to those who want to use   Wix Payments as their payment provider. You can still use Wix as a platform, only with a different payment provider that can support the sale of hemp and hemp-derived CBD products.
